The website 'https://www.ekishwar.com', the app 'Ek Ishwar' and/or any other website(s) and/or apps (each individually and collectively referred to as "App(s)") that are owned and/or operated by Ek Ishwar Private Limited ("We/we", "us", "our", "Ek Ishwar") which expression shall unless it be repugnant to the context or meaning thereof shall include its successors and assigns). We respect your privacy and are committed to protecting your personal information. This privacy policy ("Policy") sets out Ek Ishwar's policies and practices on collection, use, disclosure, storage, security and management of personal information obtained from you when you access or visit our App and/or access our services ("Services") or third party services ("Third Party Services") provided via our App.

By accessing, downloading, using, browsing registering on the App or availing of the Services provided on the App, you agree to be bound and be governed by the terms of this Policy and consent to our processing (which includes but is not limited to the collection, receiving, possessing, storing, dealing or handling) of your personal information in the manner as set out in this Policy. You should carefully go through the terms of this Policy, before you decide to use our App and/or avail of our Services. If you do not agree to any portion of the terms of this Policy, you should not access or otherwise use the App or avail any of our Services. This Policy has to be read in conjunction with our Terms and Conditions.

1. DATA

The personal data collected or received falls into various categories as under:

Identity and contact related information

Name, address, signatures, date of birth, copies of identity cards, contact details including email id and phone number, address, gotra, caste, religion and gender, previous names, maiden names, marital status, relatives information, nomination, medical condition, domicile, citizenship, nationality, residence, residential status, signature, photographs and any legal or other identifiers like Permanent Account Number (PAN), driver's license, voter id, utility bills, passport or other government issued identification documents.

Data that identifies (whether directly or indirectly) a particular individual, such as information you provide on any booking forms or similar online fields.

Demographic information that you provide and aggregated or de-identified Data.

Financial and payment related information

Data collected when you make or receive payments such as bank account details, credit/debit card details, prepaid payment instrument details, any other instrument/ modality/ function details, UPI handles, amounts paid for Products, seller or merchant information and history in relation to the payment transactions.

Information you provide about others or others provide about you

If you give information or data about someone else (for example, information or data about a spouse or family member for the purpose of booking a service), or someone gives information about you, may be added to any Data that is already held about you and can be used in the ways described in this Policy.

Your Data from third party providers

In order to enhance our ability to provide relevant marketing, offers, and services to you, Data about you is obtained from other sources with your consent, such as email service providers, public databases, joint marketing partners, social media platforms, as well as from other third parties as appropriate.

Information from online activities

Information about your internet activity is collected using technology known as cookies, which can often be controlled through internet browsers. For detailed information on the cookies used, see the section on 'Cookies' below.

Your digital and electronic devices where various checks are performed are designed to ascertain and verify your residency to ensure we meet our obligations under applicable law. These checks include identifying and collecting your location (with your specific permission) and the IP address your device connects from and the collection of information about your use of the App (including device type and operating system).

Information about your internet browser, IP address, information collected through tracking technologies.

Unique device identifier such as International Mobile Equipment Identity (IMEI) number, technical usage data, contact lists (in some cases where specific permission is obtained), technical data about your computer and mobile device including details regarding applications and usage details.

Other personal information

  • Information in relation to grievances and complaints.
  • Photography and videography data of the Physical Pujas or Virtual Pujas which may contain your Data.
  • Records of correspondence and other communications with you, including email, WhatsApp calls and messages, telephone calls and live chat or instant messages.
  • Calls or communications made with our Representatives.
  • Details of social relationships such as your father's name, spouse's name, mother's name, names of other family members or relatives.
  • Your browsing actions, patterns and online activity.
  • Any other information, Data or records which you may consent to be collected or used.

Sensitive personal data or information

Out of the aforesaid data points, the following are 'sensitive personal data or information':

  • password
  • financial information such as bank account or credit card or debit card or other payment instrument details;
  • physical, physiological and mental health condition;
  • sexual orientation;
  • medical records and history;
  • biometric information; and
  • any detail relating to the above clauses as provided by you.

Provided that, any information that is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other law for the time being in force shall not be regarded as 'sensitive personal data or information'.

Any of the aforesaid data (whether personal data or sensitive personal data or information), any derivative thereof like any behavioural projections, profiling, analytical results, reports (prepared by us or others) including through any algorithms, analytics, software, automations, etc., and whether such derivative is from the information collected from you or in combination with any other information sourced from any other person, database or source whether by us or others, shall collectively be referred to as "Data".

2. WHEN AND HOW YOUR DATA IS COLLECTED?

Your Data may be collected or processed through any of the following:

  • When you use the App.
  • When you provide Data to us including during registration on the App.
  • When you purchase any Products.
  • When you avail of any Services.
  • While undertaking any bookings through the App.
  • While making payments for any of the Products or Services.
  • While you visit our Kiosks.
  • When you communicate with the Pandits for the Pujas.
  • During the course of your interaction with us for scheduling the Puja/ Darshan.
  • When you email or call or respond to our emails/phone calls or during meetings with our service providers or Representatives.
  • When you or others give the Data verbally or in writing. This Data may be on application forms, in records of your transactions or if you make a complaint.
  • From information publicly available about you. When you make Data about yourself publicly available on your social media accounts or where you choose to make the Data available through your social media account, and where it is appropriate to be used.
  • Data collected through cookies.

By accepting this Policy or by applying for or using the App or the Services, you agree that any person who submits any Data to us shall be deemed to have been authorised by you to submit such Data to us and you hereby further authorise the processing of any such Data by us or for us, for any of the purposes mentioned in this Policy.

3. HOW WE PROCESS YOUR DATA?

Whether we're using it to confirm your identity, to help in the processing of an order for purchase of a Product or providing you with a Service or to improve your experiences with us, your Data is always handled with care and the principles outlined in this Policy are always applied.

4. PURPOSES OF PROCESSING DATA

The processing of the Data may be done by us or any of our employees, agents, service providers, Representatives or third parties with whom we have contracts for services, for any of the following purposes, and you agree and consent to the same:

  • To enable your use of the Apps.
  • To provide you with Products.
  • To provide you with Services.
  • For processing your payment transactions.
  • For delivering the Products to you.
  • For resolving your complaints/ grievances.
  • To contact you or to establish contact with you to schedule Pujas or in relation to the Pujas/ Darshans.
  • To allow you to utilize features on our Apps by granting us access to Data from your device.
  • For security and fraud monitoring purposes.
  • For system or product development, audit and administrative purposes.
  • To enable one-time passwords to be sent to you for App registration/ authentication.
  • To improve customer/ user experience.
  • To inform you about important information regarding our Services, Products, delivery information, changes to terms, conditions, and policies and/or other administrative information.
  • Where processing is necessary for the performance of a contract to which you are a party or in order to take steps prior to entering into a contract.
  • Where processing is necessary because of a legal or regulatory obligation that applies to us.
  • Where processing is necessary for the purposes of the legitimate interests pursued by us or by a third party.
  • Where processing is necessary to protect your interests where we need to process your Data and you are not capable of providing consent (emergency situations).
  • Where we have your consent to do so.

We may also contact you or send you messages, notifications, banners, alerts, WhatsApp messages, in-App notifications, push notifications through telephone, text, email, social media and other digital methods.

For any purposes which are incidental or necessary to any of the aforesaid purposes.

You agree that Ek Ishwar may engage with any service provider or third-party entity, for any of the aforesaid purposes or part thereof for any incidental or ancillary purposes and may accordingly share Data with any of them and allow them to further process/ share the same, for the said purposes.

5. WHO WE SHARE YOUR DATA WITH?

We may share the Data with the following persons and/or in the following circumstances:

  • With our employees, representatives, service providers, vendors, agents etc. who perform services for us or assist us to provide the Services or Third-party Services, intermediaries or consultants.
  • With Temple authorities, staff employed by Temples and Pandits for providing the Puja and Darshan services.
  • With service providers that we engage for your mobile number registration on the App.
  • With service providers that we engage for providing you any booking services.
  • With delivery agents and courier services providers for enabling delivery of your Products.
  • With doctors, health care professionals or law enforcement personnel to respond to an emergency.
  • Other third parties to comply with legal requirements such as court orders; to verify or enforce our terms of use, our other rights, or other applicable policies; to address fraud, security or technical issues; or otherwise to protect the rights, property or security of our customers or third parties.

We may share your Data, without obtaining your consent or without intimating you: (a) with governmental, statutory, regulatory, executive, law-enforcement, investigating or judicial/ quasi-judicial authorities, departments, instrumentalities, agencies, institutions, boards, commissions, courts, tribunals, who ask for such Data including by way of an order, direction, etc; or (b) with any person, where disclosure is necessary for compliance of any legal or regulatory obligation. Wherever the Data is shared as above, we will not have control over how such Data is further processed by such authorities, persons, etc. (both under 'a' and 'b' above).

With payment service provider and acquirer bank for processing your payments.

The Data may also be shared by any of the aforesaid entities / persons with their service providers, consultants, agents, subsidiaries, affiliates, distributors, agents, or other persons with whom we have a tie-up or contract for any products or Services etc. for any of the aforesaid purposes or any purposes incidental or necessary thereto.

6. PERIOD OF STORAGE OF THE DATA

We will only store your Data for as long as we need it for the purposes for which it was collected, and where necessary. This may vary with the nature of the Data so collected. Where we provide you with any Service, such as where you register, we will retain any information you provide to us at least for as long as we continue to provide that Service to you.

We retain your Data till the period that is required for the purposes of us meeting your requests on our App. We may retain certain data as necessary:

  • For legitimate business purposes, including but not limited to auditing, accounts related;
  • If required by applicable laws;
  • To prevent fraud or misuse of Services; or
  • For the purpose of any contract (which may extend beyond the termination of our relationship with you).

7. PERSONAL DATA OF CHILDREN

The App is not intended for the access or use of children under the age of 18 (eighteen) or a minor to access or use without parental consent. By accessing our App, you declare and confirm that you are 18 (eighteen) years of age or older or are either a parent or legal guardian of a minor. You also affirm that you are competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in this Policy, and to abide by and comply with this Policy. In the event that any Data of a minor is disclosed to us, by you either as a parent or the legal guardian, you hereby consent to the processing of the minor's Data and accept and agree to be bound by this Policy and take responsibility for his or her actions.

8. PERSONAL DATA OF OTHER INDIVIDUALS

In some situations, you may provide Data of other individuals (family, kids grandparents, friends, likewise) to us. If you provide us with such Data, you attest, declare, represent and warrant to us that you are fully and duly legally authorized to share and have obtained their express consent for their Data to be collected, used, and disclosed as set out in this Policy. In case any information / documents of minors is uploaded / shared, you additionally attest, declare, represent and warrant to us that you are the parent and/or the legal guardian of such minor.

9. REASONABLE SECURITY PRACTICES AND PROCEDURES

We seek to use reasonable organizational, technical and administrative measures to protect Data within our organization. However, if you have reason to believe that your interaction with us is no longer secure, please immediately notify us in accordance with the 'How to contact us' section.

10. LINKS TO THIRD PARTY WEBSITES

From time to time, our website/ webpage/ platform/ App may contain links or have a mechanism of re-direction to and from websites/ webpages/ platforms/ apps of other networks, advertisers, affiliates, service providers and/or Temples. If you follow a link or such re-direction to any of these websites/ webpages/ platforms/ apps, please note that these websites/ webpages/ platforms/ apps may have their own privacy notices and that we do not accept any responsibility or liability for any such notices. Please check such notices, where available, before you submit any Data to these websites/ webpages/ platforms/ apps.

11. RIGHT TO REVIEW

Please note that the accuracy of the Data provided to us is essential, among others, for the provision of Services to you. It is therefore mandatory that you ensure the accuracy and completeness of all Data disclosed or shared. Without prejudice to any rights and remedies of Ek Ishwar under any contract in this regard, you shall be able to review the Data that you had provided and correct or amend as feasible any such Data which you find to be inaccurate or deficient. You may do this by following the process prescribed by us in this regard. For knowing the process, you may contact us as per the section 'How to contact us' under this Policy. Provided that Ek Ishwar shall not be responsible for the authenticity of the Data supplied by you to us.

12. COOKIES

We may use cookies and similar technologies on our Apps and in our emails. Cookies are text files that get small amounts of information, which your computer or mobile device stores when you visit a website or use a mobile app. We set or access cookies on your web or mobile browser to distinguish you from other users of the Services. This helps us to provide you with a good experience when you use the Services and also allows us to improve the Services. In case you would prefer not to receive cookies, you can alter your browser's configuration to refuse cookies.

We may use Web Beacons in order to develop and analyze use of the Service. Web Beacons (sometimes referred to as "clear gifs") collect only limited information that includes a cookie number, time and date of a page view, and a description of the page on which the Web Beacon resides. These Web Beacons do not carry any personally identifiable information and are only used to track usage of the Apps and activities associated with the Apps.

The details of the Grievance Officer may be changed by us from time to time by updating this Policy. When submitting the grievance, please provide your complete contact details, including name, address, telephone number, mobile number and e-mail address. If we do not receive an e-mail address, we will respond by postal mail. Please ensure that your grievance contains complete details in relation to your complaint or query to enable us to effectively and expeditiously address the same. Please sufficiently describe the nature of your grievance along with providing supporting documents evidencing the grievance raised. If, at any time it is found that the grievance raised was malicious or the person raising the grievance has made the same knowing it to be false or the person raising the grievance has produced any forged or misleading document, then the same could result in civil and/or criminal liability against such person.

14. CHANGES TO THIS POLICY

Our Products, Services and functionalities thereof change and our Policy will change also. You will be responsible for apprising yourself about the Policy and change, if any, on each use of our Apps or while applying for or making service requests for any Service or Product or making any bookings. Without limiting your responsibility to keep yourself updated as above, we may update you that a change has been made through any channels of communication including through App notifications. The changed Policy shall be effective as soon as it is hosted on our website/ App. If you use our website or App or avail of any Service or purchase any Product, such act of any of aforesaid uses shall by itself amount to your acceptance of the Policy with changes, if any.

15. GOVERNING LAW

This Policy shall be governed by the laws of India and any disputes arising out of or in relation to this Policy shall be subject to the jurisdiction of courts/ tribunals of Mumbai, India.
