1. SERVICES

Account Registration

1.1 As a condition to the use of the App, you represent and warrant that you are 18 years or older. We retain the right at our sole discretion to deny access to the App to anyone at any time and for any reason, including, but not limited to, for violation of these Terms and Conditions.

1.2 You can register for our Services by providing us with your Personal Information as may be indicated within the App, and required by us. We process such personal information shared by you, as per the applicable laws and our Privacy Policy available on our App.

1.3 You are responsible for safeguarding your account and you agree not to disclose your password to any third party. You agree that you will be solely responsible for any activities or actions taken under your account, irrespective of whether you have authorized such activities or actions. You will immediately notify Ek Ishwar of any unauthorized use of your account or any suspicion or threat of unauthorized use, that comes to your knowledge. You shall not use false identities or impersonate any other person or use a username or password that you are not authorized to use.

1.4 You acknowledge that for registration on the App we may use third party services and you consent to our sharing your Data including mobile number with such third parties and for such third party to sending you one-time passwords to your mobile number.

1.5 While we implement reasonable precautions to protect your information, we do not and cannot guarantee or warrant that information transmitted through the internet is secure, or that such transmissions are free from delay, interruption, interception or error.

Use of Services

1.6 The App and the Services provided by us is only for your personal and non-commercial use. In the event that you upload or otherwise share any information / documents about other individuals (whether members of your family or otherwise) on / via the App for the purposes of availing any of the Services, then you attest, declare, represent and warrant to us that you are fully and duly legally authorized and that you have the express consent from such individual(s) to share and/or otherwise deal with all such information / documents for and on their behalf for the purposes of availing the concerned Services and that you shall be fully responsible for all acts and omissions of any nature arising in connection with their information / documents. In case any information / documents of minors is uploaded / shared, you additionally attest, declare, represent and warrant to us that you are the parent and/or the legal guardian of such minor.

Sale of Ek Ishwar products

1.7 You may be able to purchase certain products through the App which are sold by Ek Ishwar (“ Ek Ishwar Products ”). In case you have any issues or grievances pertaining to such products, please contact our Grievance Officer as mentioned in the ‘Grievance Officer’ section below. While Ek Ishwar endeavors to be as accurate as possible in the description of the Ek Ishwar Products sold on the App, however, we do not warrant the accuracy or completeness of the product description, colour, information or other content thereof. The product descriptions, pricing and/or information regarding the availability of the products may contain typographical errors or inaccuracies and may not be complete or current. The photographs, if any, of the Ek Ishwar Products are indicative and may not match the actual product in all cases. Ek Ishwar reserves the right to correct, change or update information, errors, inaccuracies or omissions at any time (including after you have availed of such a product) without prior notice or intimation.

Sale of Third Party Products

1.8 You may be able to purchase certain products through the App which are manufactured and sold by third party sellers (“ Third Party Products”). You agree and acknowledge that for such Third Party Products, the App is only a marketplace and Ek Ishwar is only acting as a facilitator and platform provider. The provision of the Third Party Products are an independent offering of the respective sellers, and if you choose to avail the same, such purchase of the Third Party Products shall be an independent contract between you and the sellers including without limitation the terms of such contract inter alia the price, warranty, delivery and after sales services. Ek Ishwar is not providing, selling, warranting, guaranteeing or endorsing the Third Party Products nor is it assuring the quality, suitability or fitness of the Third Party Products for you. Ek Ishwar shall in no manner be liable for any non-performance of any terms of the contract by the sellers or any product level issues or any mis-selling, false description or misrepresentation by the sellers on the App. Any dispute or issues pertaining to the product shall be a matter between You and the seller and Ek Ishwar shall not be liable for or party to any such disputes.

Delivery of products

1.9 You hereby agree and acknowledge that any complaints pertaining to the delivery or non-delivery of any Ek Ishwar Product or Third Party Product sold through the App (collectively, “Product(s)”) shall be made to Ek Ishwar by writing to us as provided in the Grievance Officer paragraph, within 7 (seven) days from the indicative date of delivery displayed on the App. Any non-receipt of any communication by you will be deemed to mean that you have satisfactorily received the Product. Ek Ishwar disclaims any liability for any complaints beyond the said 7 (seven) day period.

1.10 All delivery timelines provided on the App are indicative in nature and subject to change based on factors including but not limited to location, availability of the Products, courier schedules, weather conditions and unforeseen delays. You acknowledge and accept that the actual delivery by the delivery agent/ courier company may take longer due to circumstances beyond our control. Ek Ishwar shall not be held liable for any delay in delivery or any errors or misuse by or misbehavior of the delivery agent/ courier companies, and no compensation or refund shall be provided on account of such instances. For bulk orders the delivery timeline will be communicated separately by our team to the Devotee.

Puja boxes

1.11 Some items included in the Puja boxes may appear to be edible but are not intended for consumption unless explicitly mentioned/labelled as consumable on the packaging or in the product description. Some of the items are provided strictly for ritualistic purposes only and should not be consumed in any scenario. You agree to read the labels carefully and exercise caution before consuming or utilizing any item. Ek Ishwar shall not be liable for any health issues or reactions arising out of the consumption of items not expressly labelled as consumable.

Physical Puja/ Darshan

1.12 Each Devotee shall ensure that it carries the government issued identification documents such as passport, drivers license or voter ID for any visit to the Temples including for Physical Puja or Darshan for us or our Representatives or the Temple authorities to verify your identity. You hereby authorise Ek Ishwar and our Representatives to collect and preserve copies (including soft copies) of your identification documents.

1.13 Ek Ishwar reserves the right to deny entry or access to the Services and/or the Physical Puja/ Darshan in the event of failure to produce valid identification documents as above or any discrepancy in the registration details provided on the App. No exceptions shall be made in this regard, and we shall not be liable for any claims, losses, or damages arising from denial of admission due to non-compliance with these requirements

1.14 You acknowledge that Temples are crowded places and the number of people present in the Temple may be substantially high during festive periods or on auspicious events and may pose the risk of accidents and stampedes. You further acknowledge that our Services such as Physical Puja, Physical Darshan may involve physically demanding activities such as prolonged standing or walking in crowded or enclosed spaces, waiting in queues, climbing steps, or navigating uneven terrain depending on the time and location of availing the Services and may result in physical or mental exhaustion. Therefore, you must ensure that they are of adequate health and ability to avail of these Services. Further, you agree to consult a specialist prior to travelling for such Puja and participating in the Physical Puja or Darshan based on their health conditions. Ek Ishwar shall not be liable for any accident, health complication, or adverse outcome arising from your visit to the Temple or participation in the Physical Puja/ Darshan or any physical harm, personal injury or death, caused by any other person or third party including any other devotees present at the Temple.

1.15 You further acknowledge and agree that any entry to the Temples is subject to the sole discretion of the Temple authorities and the Temple authorities reserve the right to deny admission into the Temple and Ek Ishwar shall in no manner be responsible for any loss incurred by you in case of such an occurrence. You agree that entry to the Temples will be subject to Hindu traditions and the prescriptions and guidelines of the individual Temples. You may prior to booking a Puja (whether physical or virtual) familiarise yourself with the prescriptions and guidelines of the individual Temples and ensure adherence to the same during the course of your visit to the Temple and while attending the Puja (whether physical or virtual).

Kiosks and QR Code

1.16 Ek Ishwar may have designated kiosks near or in the Temple premises ( "Kiosks") wherein the Ek Ishwar personnel ("Representatives") will be present to scan the QR Code and verify your identity and scan/ collect copies of your identification documents. You shall be required to extend your full co- operation with the Representatives at the Kiosk.

1.17 The QR Code(s) issued to you on the App, shall be valid only for a specific Physical Puja and/or Physical Darshan at a specified Temple to be held at a specific date and time as mentioned to you at the time of booking and shall not be available for use for entry into the Temple on another date or time. A QR Code once issued shall be non-refundable and non-transferable. You shall at all times be solely responsible for the protection and safekeep of the QR Code. Ek Ishwar shall not issue a duplicate QR Code including in case of any loss of the QR Code by the Devotee, loss of the mobile phone, tablet, laptop or any other device ("Device") on which the QR Code resides, loss of the credentials to access the App or loss of access to the App.

1.18 Ek Ishwar shall not be held liable for any technical glitches, errors in generation, or failure to scan the QR code at the Kiosk due to device-related issues, poor connectivity, or any other reason beyond its control. It is your responsibility to ensure that the QR code is downloaded in advance, clearly visible on their Device, or carried as a printed copy if required. We recommend that you arrive well before the scheduled time of your Physical Puja/ Darshan and present the QR code at the Kiosk to our Representative to facilitate smooth entry into the Temple premises.

Information available on the App

1.19 The information provided on the App, including but not limited to description of Temples, auspicious occasions, events, timings and/or facilities Ek Ishwar endeavors to provide be as accurate as possible in the description of the Ek Ishwar Products sold on the App, however, we do not warrant the accuracy or completeness of the product description, colour, information or other content thereof. The product descriptions, pricing and/or information regarding the availability of the Products may contain typographical errors or inaccuracies and may not be complete or current. The photographs, if any, of the Ek Ishwar Products are indicative and may not match the actual product in all cases. Ek Ishwar reserves the right to correct, change or update information, errors, inaccuracies or omissions at any time (including after you have availed of such a Product) without prior notice or intimation.

Virtual Puja

1.20 For conducting the Virtual Puja, the Pandit may ask for certain personal details such as your name, gotra, or other Data as is customary for performing the ritual and you acknowledge that that your name, gotra and such other Data may also be recited by the Pandit during the Virtual Puja and this Data will also form part of the recording that will be sent to you and the other Devotees that have participated in that Puja. You hereby authorise Ek Ishwar for using your Data for the said purpose and manner and waive any objection in regard to the same.

1.21 You hereby also consent to receiving calls and messages including (including through WhatsApp calls and messages) through our Representatives or through the Pandits for purposes such as scheduling the Virtual Pujas, for communication with the Pandits for collecting your Data for reciting during the Virtual Puja as mentioned above.

1.22 Ek Ishwar will make reasonable efforts to notify you prior to your scheduled Virtual Puja. However, if you fail to answer the call (including WhatsApp call), or if you are in a low network area during the scheduled time of the Virtual Puja and our Representatives or Pandits are unable to reach you, the Pandit may not receive your details, and as a result, your name may not be included in the Puja. We shall not be held responsible for any losses that you may incur in relation due to such omissions.

Timings

1.23 All timings communicated by Ek Ishwar on the App shall be in Indian Standard Time (IST). Further, you acknowledge that the timing of Puja communicated is only approximate and subject to change by the Temple authorities and Pandits depending on their availability.

Third-Party Services

1.24 We may have tie ups with third parties such as 'Heritage Aviation' to facilitate and connect you with services offered by such service providers. Please note that such services are shown on our App only for your convenience and any booking or use of services provided by Heritage Aviation shall constitute an independent contract between you and Heritage Aviation. Ek Ishwar does not control, endorse or supervise the services offered by Heritage Aviation. We shall not be held liable for any disputes or issues arising out of your use of Heritage Aviation's services. We recommend that you carefully read Heritage Aviation's own terms and conditions before proceeding with any booking.

Discounts

1.25 We may from time to time, collaborate with third-party partners to offer discounts, promotional benefits, special offers ("Discounts") on our Products and Services. You acknowledge and agree that all Discounts are subject to availability and applicable terms and conditions. The availability and terms of such Discounts shall be subject to the discretion of Ek Ishwar, and may be modified or discontinued at any time by us. Further, we may impose certain conditional limits on the number of times such discounts can be availed.

Subscription services

1.26 We may offer you certain Services such as access to our music library and discount vouchers either free of cost, or upon payment of subscription fees. Such fees shall be communicated to you in advance, and such Services, in part or in full, will become available to you upon payment. If you decline to pay the relevant fees, we shall not be bound to provide the locked content or paid-for Services.

Payments

1.27 The value of the Services and/or Products may be subject to duties, foreign transactions fee, currency exchange or other fees applicable in India and/or your country of residence. The relevant payment processing entity such as payment aggregator or bank may convert the payment into the local currency (of your country of residence) and may charge fees, resulting in differences between the amount displayed on the App, and the final amount charged to you.

1.28 We are not a charitable institution, and any payments made to us for the Services would not constitute or payments towards charitable purposes or donations. Being an e-commerce platform provider, we cannot issue any tax deduction receipts for any bookings made by you through the App and any payments made to us are not eligible for any tax deductions under Section 80G (Income-tax Act, 1961).

2. CONSENT

2.1 During the course of your interaction with us, we may also collect certain personal data or sensitive personal information, pertaining to your or other persons including the other Devotees that you register on the App, such as financial information such as bank account, credit/ debit card, payment details, religion, gender, caste or location details (“ Data”). We collect this Data in order to provide you our Services. You hereby confirm that any Data furnished by you is accurate and does not suffer from any deficiencies.

2.2 You hereby consent to and authorize Ek Ishwar to process, use, store, preserve, share any Data provided by you through the App or by providing the same to our Representatives for or in relation to: (i) booking and/or providing you with the Services; (ii) for processing your orders for Products placed through the App; (iii) sharing with third parties such as our delivery partners, Representatives, Temple authorities and/or Pandits, in order to provide you the Services and/or process your purchases of the Products; (iv) addressing your complaints/ grievances; (v) calling (including through WhatsApp calls), emailing, communicating, messaging (including through WhatsApp messages) or contacting you; (vi) deploying any analytics or algorithms; (vii) in relation to any purposes required under applicable law; (viii) legal or court proceedings or for any disputes; (ix) sharing with law enforcement agencies or other regulatory authorities including to report any illegal, suspicious or fraudulent activities.

2.3 The Puja may be recorded by way of photography and/or videography and such photos and videos may also be shared with other Devotees who have attended the same Puja and you hereby agree and consent to such photography and/or videography by Ek Ishwar and/or the representatives of the Temples and to the sharing of the same with other Devotees.

3. PROHIBITED BEHAVIOUR AND OTHER RESTRICTIONS

3.1 During your use of our App or the Services, you shall not directly or indirectly engage or assist any third party in any behavior, which may amount to "Prohibited Behavior" as determined by us or the Temple authorities or the Pandits, as the case may be, in our sole discretion and which includes, without limitation:

• (a) Any unlawful, illegal or anti-social activity including at the Temples, Kiosks, with the Representatives, Pandits and during Physical Pujas;
• (b) Any violence, bullying, blasphemous, abusive, indecent, obscene, offensive,trolling, propaganda or insulting behavior or harassment/ sexual harassment or invasive of privacy of the other devotees participating in the Physical Puja, the Pandits or any other persons present at the Temple;
• (c) Threaten the security, peace or harmony of the Temple in any manner;
• (d) Hate speech, racial slurs, bigotry or ethnically disparaging language;
• (e) Impersonate any Devotee(s) registered on the App or any other person;
• (f) Misrepresent identity, impersonate any person or attempt to gain access to the Temples, Physical Pujas or illegally track any account, data, device, system, or network related to the Services;
• (g) Disrupt, interrupt or cause interference in or during the Pujas (whether physical or virtual);
• (h) Upload, store, share or transmit any sexually explicit material, offensive material and/or any unlawful / illegal material;
• (i) Copy or duplicate in any manner any of the content or other information available on the App;
• (j) Hotlink any content or information hosted on the App;
• (k) Any activity that harms or disrupts the operations or performance of the Pujas (whether physical or virtual), the App or the Services;
• (l) Use of the App / Services to upload, modify, publish, transmit, store, update or share any information which deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any misinformation or information which is patently false and untrue or misleading in nature;
• (m) Use of the App / Services or to provide assistance to any third party to copy, upload, store, transmit, display or share any document, narrative descriptions, graphics (including photographs, illustrations, images, drawings, and logos), video recordings, and audio recordings made available through the App or the Services;
• (n) Use or manipulate the App / Services in any manner not permitted by Ek Ishwar;
• (o) Directly or indirectly reverse engineer, decompile, disassemble, modify, reproduce or create derivative works of the App / Services;
• (p) Alter or modify any disabling mechanism, which may be included in the App / Services, including tampering with the security of the App / Services or tamper with other customer accounts of Ek Ishwar;
• (q) Assign, sublicense, rent, timeshare, loan, lease or otherwise transfer the use / access of the App / Services;
• (r) Remove or alter any proprietary notices (e.g., copyright, trademark notices, legends, etc.) from the App / Services or copy any ideas, features, functions, or graphics of the App / Services;
• (s) Use the App / Services to send unsolicited advertising and/or promotional materials, including, without limitation, ‘spam’ or bulk e-mail, including without limitation any use of the App / Services in violation of any of the applicable laws.

3.2 You acknowledge that the Physical Puja/ Darshan booked by you may have other devotees participating in the same Puja/ Darshan who may or may not have come through the Ek Ishwar App and/or who may be present at the place of the Puja/ Darshan. You agree to attend the Puja/ Darshan with such other devotees in a peaceful manner while ensuring decorum.

3.3 Further, you agree not to: circumvent, remove, degrade, deactivate, or thwart any of the contents of our Service and/or App; use any robot, spider, scraper, or other means to access our Service and/or App. You also agree not to decompile, reverse engineer, and disassemble our App and/or any software or other products or processes accessible through our App / Service. Additionally, you agree not to upload, post, e-mail or otherwise send or transmit any material designed to interrupt, destroy, or limit the functionality of our App / Service.

3.4 Our music library gives access to a wide range of devotional content. You may access our music library for personal and non-commercial use only. You acknowledge that content available on our music library is protected under applicable intellectual property laws. The rights in such content are owned by the respective authors or rights holders, who are entitled to protection against any unauthorized use or infringement. By accessing our music library you agree to not infringe such intellectual property rights of the authors by recording, copying, reproducing, distributing, modifying, publicly performing, or communicating the content to the public or engaging in any act without proper authorization that may constitute infringement.

4. SECURITY MEASURES

4.1 You shall ensure that it must use the App securely, including but not limited to (i) keeping the credentials (including one time password) strictly confidential, not letting any unauthorized person have access to the App, (ii) putting in place a passcode or PIN to lock/ restrict access to Device on which the App resides, (iii) securing it from any unauthorized access, (iv) not sharing such passcode with any other person), (v) taking adequate precautions from any ransomware, malware or virus from entering the App including installing adequate anti-virus protection, (vi) not letting any unauthorized person have access to the QR Code issued by Ek Ishwar.

4.2 Any person having access to the mobile number, App, Device, QR Code or one-time password of the Devotee, shall be deemed to be acting for and on behalf of the Devotee, with the authority and intention to bind the Devotee.

5. DISCLAIMER AND LIMITATION OF LIABILITY

5.1 TO THE MAXIMUM EXTENT NOT PROHIBITED BY LAW, THE SERVICES INCLUDING THE APP ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, AND EK ISHWAR AND ITS LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS AND IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE AND USAGE OF TRADE. YOUR USE OF THE SERVICES IS SOLELY AT YOUR OWN RISK. FURTHERMORE, EK ISHWAR AND ITS LICENSORS DO NOT WARRANT THAT THE SERVICES INCLUDING THE APP WILL BE UNINTERRUPTED OR ERROR FREE, OR THAT DEFECTS WILL BE CORRECTED. EK ISHWAR DOES NOT WARRANT THAT FILES, IMAGES, VIDEO-RECORDINGS OR QR CODES AVAILABLE FOR DOWNLOAD WILL BE FREE OF VIRUSES, WORMS, TROJAN HORSES OR OTHER DESTRUCTIVE PROGRAMMING. ANY MATERIAL OBTAINED THROUGH THE USE OF THE SERVICES INCLDUING THE APP IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE, OPERATING SYSTEM OR LOSS OF DATA THAT RESULTS FROM ANY SUCH MATERIAL. WE MAKE NO WARRANTY REGARDING THE QUALITY, ACCURACY, TIMELINESS, TRUTHFULNESS, COMPLETENESS OR RELIABILITY OF ANY CONTENT.

5.2 Ek Ishwar is not liable for any claims, losses, damages resulting from the use of or the inability to use the App or due to any technical glitches, error, disconnection, interruptions at any time of accessing the App.

5.3 Ek Ishwar acts only as a facilitator by providing the App which connects the Devotees with the Temples and Pandits for the Puja/ Darshan, and Ek Ishwar is in no way responsible or liable for the manner of conducting of the Puja/ Darshan by the Pandit and Ek Ishwar shall not be liable for any acts, omissions, errors, representations, warranties, breaches, negligence or deficiency in the performance of the services on part of the Temples and/or the Pandits (whether Virtual or Physical). During the Virtual Puja/ Darshan or while on the Temple premises, any issues or concerns faced by you at any time of the Physical Puja/ Darshan shall be a matter between you and the Temples authorities and/or the Pandits and Ek Ishwar shall not be liable for the same.

5.4 You acknowledge and undertake that you will be availing of the Services at your own risk and using your best and prudent judgment before as regards the suitability of the Services prior to making any purchases or booking or availing of any Services through the App. Ek Ishwar shall not be liable for any claims, losses, damages resulting from the use of or the inability to use the Services including in the event of any delays in the Pujas, Darshans and/or on account of any accidents, theft, loss of belongings, stampede, personal injury, physical harm or fatalities occurring during Pujas, Darshans, Temple visits, rituals, travel or at any time of availing such Services including by any other person or third party including any other devotees present at the Temple.

5.5 As regards the delivery of the Products, Ek Ishwar is only acting as a facilitator between the Devotees and the delivery agents/ courier companies, and such delivery agents/ courier companies are independent contractors and the services provided by them are governed by their own terms. Ek Ishwar is not acting as an agent for such delivery agents/ courier companies.

5.6 Our Services are available in limited jurisdiction including India, US, UK, Canada, UAE, Europe, Australia & Singapore. We reserve the right to add or delete to the list of jurisdictions we operate in without any notice or intimation to anyone.

5.7 In no event shall Ek Ishwar and its owners, directors, officers, agents, shareholders and partners be liable for any loss or damage whatsoever including without limitation direct, indirect, punitive, incidental and consequential damages, lost profits, or damages resulting from the use or inability to use the App whether based on warranty, contract, tort or in any other means or action.

6. FORCE MAJEURE

Ek Ishwar shall not be held liable for any failure to perform or any delay in performance of its obligations under these Terms of Use where such failure or delay is caused, directly or indirectly, by events beyond its reasonable control. These events include but are not limited to acts of God, natural disasters, floods, storms, adverse weather conditions, fire, epidemic or pandemic, war, terrorism, riot, civil commotion, strikes, labour disputes, lockdowns, governmental restrictions or regulations, breakdown of telecommunications or internet services, power outages or any other circumstances that could not have been reasonably foreseen or prevented.

7. REFUNDS/ CANCELLATION

Pujas/ Darshans

7.1 Any Puja or Darshan (Physical or Virtual) booked through the App are based on a limited availability of slots for such services from the respective Temples and Pandits and once scheduled Ek Ishwar is not in a position to cancel such bookings. Each confirmed booking reserves a slot for You that could have been offered to another customer and accordingly any cancellation by you leads to a direct loss of opportunity for others and losses for us. Hence, the Pujas or Darshans (Physical or Virtual) once booked are not cancellable and non-refundable.

Products

7.2 Several of our Product are custom made and made to order and therefore Ek Ishwar does not offer any returns, refunds or cancellations on the Products purchased through the App. Further, our Products undergo inspection and checks prior to being shipped to you. However, in case of a rare circumstance in which you receive a damaged Product or a Product with a manufacturing defect, Ek Ishwar may consider providing a refund provided that you share along with the refund request an unaltered video of unboxing of the original packaging of the Product received by you, evidencing that the Product was not damaged subsequent to being delivered to you.

7.3 Any request for return in the said circumstances, should be made by writing to us within a period of 7 (seven) days from the date of receiving the Product. Any request without a video as above or made beyond the 7 days window will not be entertained.

Subscriptions

7.4 Once you subscribe and avail any benefit under any of our subscription plans, you will not be permitted to seek a refund for the subscription.

8. THIRD PARTY LINKS

The App may provide hyperlinks to other websites maintained by third parties, including for viewing or streaming Virtual Darshan. Ek Ishwar may also provide third party content on the App including information regarding Temples, timings of Pujas, etc. Please note that once you are re-directed to such third party website, you shall be bound by the terms and conditions of that website, which shall be an independent contract between you and the said third party. The links to third party websites are provided for your convenience and information only. The content on any linked website is not under Ek Ishwar's control and Ek Ishwar is not responsible for any interruptions in the access of the third party websites or the live stream of the Virtual Darshan or any content of linked websites, including any further links contained in a third party website. If you decide to access any of the third party websites linked to the website, you do so entirely at your own risk.

9. GOVERNING LAW AND DISPUTE RESOLUTION

These terms shall be governed by the laws of India, without regards to any conflict of law provisions. Any dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai.

10. GRIEVANCE OFFICER

10.1 We have a Grievance Officer to address your concerns and queries regarding data safety, privacy, and App usage concerns. We will resolve the issues raised by you within 30 (thirty) days from receiving them. We have created a method for you to get in touch with us and for us to address your concerns.

10.2 You may contact the Grievance Officer at any of the following:

10.3 When submitting the grievance, please provide your complete contact details, including name, address, telephone number, mobile number and e-mail address. If we do not receive an e-mail address, we will respond by postal mail.

10.4 Please ensure that your grievance contains complete details in relation to your complaint or query to enable us to effectively and expeditiously address the same. Please sufficiently describe the nature of your grievance along with providing supporting documents evidencing the grievance raised.

10.5 If, at any time it is found that the grievance raised was malicious or the person raising the grievance has made the same knowing it to be false or the person raising the grievance has produced any forged or misleading document, then the same could result in civil and/or criminal liability against such person.

10.6 Please note that any grievances pertaining to any of the Services shall be made to Ek Ishwar by writing to us as above within a period of 7 (seven) days from the date of the booking or of the Service as the case may be. Ek Ishwar disclaims any liability for any grievances beyond the said 7 (seven) day period.

11. INDEMNITY

You agree to indemnify and hold Ek Ishwar (and its officers, partners, directors, employees, agents and Representatives) harmless against all claims, liabilities, losses, penalties, expenses, damages and costs, including reasonable attorneys' fees, resulting from or relating to your:

• (a) use of and access to the App,
• (b) any breach by you of any of the Terms and Conditions contained herein,
• (c) any breach by you of any other policies, guidelines, conditions or terms entered into between Ek Ishwar and you in relation to your use of the App and/or Services,
• (d) any breach by you of any of prescriptions or guidelines of the Temples,
• (e) any breach of applicable law by you in the course of your use of the App and/or Services.

12. INTELLECTUAL PROPERTY RIGHTS

Ek Ishwar expressly reserves all intellectual property rights in the App and any associated services, text, photographs, images, illustrations, designs, icons, programs, video clips, products, processes, technology, content and any other materials, which form a part of the App. Access to the App in general does not confer and shall not be considered as conferring upon anyone any license under any of the Ek Ishwar's or any third party's intellectual property rights. All rights, including copyright, in the App are owned by or licensed to Ek Ishwar. Any use of the App or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of Ek Ishwar

13. CONSEQUENCES OF BREACH OF THE TERMS

Ek Ishwar may take action for any violations or breach of these Terms and Conditions, which we shall determine in our reasonable opinion or at our discretion for any reasons as we may think deem fit, suo moto or in response to complaints, including but not limited to suspending/ blocking/ preventing any future access the App without any notice to you, cancelling your bookings and/or initiating appropriate legal actions.

14. CHANGES TO THE TERMS AND CONDITIONS

We may from time to time change these Terms and Conditions. The term "Terms and Conditions" shall unless contrary to the context, be construed to mean these Terms and Conditions and shall include any amendments, new versions, re-hosting, restatement and/or modification thereof. We recommend that you periodically check this page for any revised Terms. Your continued use of the App or the Services will be deemed to constitute your acceptance of all such revised terms.

15. WAIVER

Failure or delay by Ek Ishwar to exercise any right or remedy available under these Terms and Conditions does not mean a waiver of that right or remedy.

16. SEVERABILITY

If any provision or provisions of these Terms and Conditions, shall be held to be illegal, invalid, or, unenforceable, the validity, legality, and enforceability of the remaining provisions shall remain in full force and effect.
